Legal framework

The legal framework for alcohol advertising in Romania

Promoting alcoholic beverages is regulated by:

  • Law 196/2003 on preventing pornography (it also includes restrictions on advertising for addictive substances).
  • CNA Decision 220/2011 on the Audiovisual Code. The chapter on alcohol advertising, applicable to TV and radio and extended editorially to online.
  • The Fiscal Code, Title VIII. Excise duties on alcohol. Producers or importers must prove payment of the excise duty.
  • Government Emergency Ordinance 12/2006. Ban on selling alcoholic beverages to minors under 18.
  • EU Code on Commercial Communications for Alcoholic Beverages. Voluntary recommendations applied by the industry.

Rules for advertising

The advertising material must not:

  • Address minors under 18 directly (language, images, extremely youthful contexts).
  • Suggest that alcohol improves physical, intellectual, social or sexual performance.
  • Associate alcohol with driving vehicles or operating machinery.
  • Present abstinence as a negative attitude.
  • Promote excessive consumption or drinking competitions.
  • Contain images with minors or people who look under 25.
  • Claim therapeutic or medical effects of alcohol.
Recommended mention

"Excessive alcohol consumption is seriously harmful to health". A standard text recommended in responsible advertising, although not mandatory online (it is mandatory on packaging and TV). Many Romanian publications require it as editorial policy.

Recommendations

Content recommendations

The most effective articles in the alcohol niche are those that:

  • Emphasize quality, tradition, terroir, not the alcoholic effects.
  • Include pairing recommendations (wine and food, cocktail and occasion).
  • Present the cultural context (the tradition of Romanian wines, the history of local distilleries).
  • Use elegant images (bottle, glass on a table, vineyard, still), not parties with excessive consumption.
  • Include moderation mentions and responsible consumption.

I am a small winery. Are the prices affordable for my budget? −
Niche publications (food, regional lifestyle, wine specialty) have more affordable prices than general publications. Filter the catalog by the "Food or Lifestyle" category.
Can I promote a cocktail bar with weekly discounts? +
Yes, promoting offers is accepted. Avoid however messages such as "All night minus 50%" or "Drink as much as you want for X lei", because they are associated with promoting excessive consumption and are generally refused.
I am an importer of Scotch whisky. Do I need Romanian authorizations? +
For import and distribution, yes: ANSVSA authorization and payment of excise duties. For promotion in articles, it is enough to prove that you are an authorized dealer of the foreign producer or a distributor with a legal supply chain.
Can I include a direct online purchase link in the article? +
Yes, if the online sale of alcohol is organized correctly (age verification at delivery, trade authorization). Your store must comply with Government Emergency Ordinance 12/2006 on the ban on selling to minors.
