Romanian legislation on promoting gambling
Promoting gambling in Romania is strictly regulated by:
- Government Emergency Ordinance 77/2009 on the organization and exploitation of gambling, with subsequent amendments.
- Law 246/2018, which created the current framework for online gambling and the ONJN as central authority.
- Government Emergency Ordinance 47/2021, which introduced the tax on advertising revenue for promoting gambling.
- The ONJN regulations, published periodically, on the content of advertising materials.
Who can be promoted
Only operators with an ONJN organization license (class I or class II) and a valid exploitation authorization can be promoted on Romanian publications. The list of authorized operators is public on onjn.gov.ro.
Who cannot be promoted
- Online casinos without an ONJN license, even if they hold a Malta, Curacao or Gibraltar license. For the Romanian market a local license is required.
- Operators on the ONJN blacklist.
- Gaming halls (slots) without an operating authorization issued by the ONJN.
- Affiliate programs that direct to unlicensed operators.
Promoting an unlicensed operator can lead to sanctions both for the publisher and for the ordering client. Articole PSK refuses orders for operators that cannot prove a valid license.
What you can publish
Operators with an ONJN class II license for online or retail sports betting.
Platforms with an ONJN class I license for remote casino games (slots, roulette, blackjack).
Authorized poker rooms, with the license mentioned in the advertising material.
ONJN-authorized number and lottery-type games, including online bingo.
Bonus codes, free spins, cashback, with the terms and conditions mentioned.
Mandatory 18 plus mention, a link to a specialized association, a warning about the risk of addiction.
Content rules for the advertising material
According to ONJN regulations, any advertising material for gambling must include:
- The minimum age 18 plus, displayed visibly.
- The operator's ONJN license number or the mention "operator licensed by the National Gambling Office".
- A warning about the risk of addiction (for example "Play responsibly. Sports betting can be addictive.").
- A link or mention of a specialized association for help (for example jocresponsabil.ro).
Not accepted:
- Images with minors or people who look under 25.
- Promises of guaranteed winnings ("you will surely win").
- Suggestions that gambling solves financial or social problems.
- Promotion towards vulnerable categories (players with addiction problems).
