Publishing Crypto, Forex and non-bank lending articles. What it is and how it helps me
Publish financial articles compliant with the ASF (forex CFD), BNR (non-bank consumer credit), MiCA (crypto-assets) and NACSA (VASP) regulations. A filtered catalog with publications that accept the niche and a compliance guide on every order.
The legal framework for financial services in Romania
Promoting financial services is regulated by category. In short:
Crypto or crypto-assets
Since 30 December 2024, EU Regulation 2023/1114 (MiCA) is directly applicable. Crypto-asset service providers (CASP) must be authorized by an EU authority. In Romania, the ASF is the competent authority. Before MiCA, exchanges were registered as VASPs with the NACSA. This obligation remains for AML and CFT.
Mandatory mentions:
- A warning about the volatility risk.
- The mention "unregulated investment" if the product does not fall under MiCA.
- The CASP authorization number, for authorized exchanges.
Forex and CFD
Regulated by the ASF (Financial Supervisory Authority), according to Law 297/2004 on capital markets. Brokers must be authorized by the ASF or hold a validated European passport. ESMA imposes leverage restrictions for retail clients:
- Standard warning: "XX% of retail accounts lose money when trading CFDs".
- Maximum leverage varying by instrument (for example 30:1 major forex, 2:1 crypto CFD).
- Margin close-out at 50%.
- Mandatory negative balance protection.
IFN (non-bank financial institution)
Regulated by the BNR through Law 93/2009 and Regulation 20/2009. Authorized IFNs are registered in the BNR Special Register (public list on bnr.ro). Unregulated ones (online loan sharks) cannot be promoted.
According to Government Emergency Ordinance 50/2010 on consumer credit agreements, the advertising material must include the APR, amount, duration and a representative example.
Publishers may refuse articles for financial operators without authorization. Articole PSK checks the authorization status before publication for the strictly regulated categories.
